Main issues, as the Inspector framed them
- Whether the periods for compliance specified in the enforcement notice fall short of what should reasonably be allowed under section 174(2)(g) of the Town and Country Planning Act 1990
What decided it
The Inspector found that the compliance periods specified in the enforcement notice were reasonable and proportionate given the time already elapsed since the appeal was submitted and the appellant's awareness that ground (a) was barred, and that the lightweight nature of much of the unauthorised structures meant limited physical work would be required to comply.
The balance between enforcement being remedial rather than punitive and maintaining public confidence in the planning system was struck in favour of upholding the notice with the stated compliance periods, notwithstanding the potential consequences for employees, the company, the local construction industry and housing delivery.
