Main issues, as the Inspector framed them

  • Whether the requirements of the listed building enforcement notice exceed what is necessary for restoring the building to its condition before the works were carried out (ground (g))
  • Whether the 18-month compliance period is too short given the scale, sensitivity and complexity of the reconstruction (ground (h))

What decided it

The enforcement notice could only require restoration to the building's condition before the unauthorised demolition works of March 2022, as evidenced by the structural appraisal and photographs of 11 August 2021, not compliance with the subsequently granted listed building consent or the statutory listing description.
