Main issues, as the Inspector framed them
- The effect of the proposal on the living conditions of the occupants of 60 Castle Road, in terms of daylight
What decided it
The significant deterioration in daylight availability to the middle bedroom of the neighbouring property, which would cause the room to be dim and gloomy with an unpleasant internal environment, was of sufficient importance and weight to significantly and demonstrably outweigh the benefits of housing delivery.
The significant positive weight given to housing delivery in the context of a substantial shortfall in housing land supply was outweighed by the overriding consideration that the Framework expects proposals to achieve a high standard of amenity for existing users, which the proposal would fail to do.
