Main issues, as the Inspector framed them
- The effect of the proposal on the character and appearance of the area with particular regard to whether it would conserve and enhance the landscape and scenic beauty of the Cornwall National Landscape (CNL) and Heritage Coast
- the effect of the proposal on ecology, with particular regard to the Pennarin Point to Portscatho Wildlife Site
- whether the proposal makes adequate provision for Biodiversity Net Gain
- whether the proposal constitutes major development within the CNL, and if so, whether there are exceptional circumstances or it can be demonstrated that the development is in the public interest
What decided it
The significant landscape and ecological harm arising from the major development within the Cornwall National Landscape was not outweighed by the benefits, and no exceptional circumstances or public interest justification was demonstrated.
The moderate economic and limited social and environmental benefits of the scheme did not outweigh the significant harm identified to the CNL, Heritage Coast and County Wildlife Site, so the proposal conflicts with the development plan and the appeal is dismissed.
