Main issues, as the Inspector framed them

  • whether the development is inappropriate development in the Green Belt having regard to the revised Framework and any relevant development plan policies
  • the effect/s of the development on the character and appearance of the locality
  • if found to be inappropriate, whether any harm by reason of inappropriateness, and any other harm, would be clearly outweighed by other considerations, so as to amount to the very special circumstances required to justify the development

What decided it

The appellant failed to demonstrate on the balance of evidence that the building was in agricultural use or that a viable agricultural enterprise existed, such that the development constitutes inappropriate development in the Green Belt with no very special circumstances to justify it.

The harm to the Green Belt by reason of inappropriateness, to which substantial weight must be given, and the harm to character and appearance, were not outweighed by the unsupported and limited-weight considerations advanced by the appellant; very special circumstances were not demonstrated.
