What decided it
The less than substantial harm to the Margate Conservation Area's character and appearance, combined with inadequate amenity space for future residents and unsecured mitigation for the SPA/SSSI, could not be outweighed by the moderate housing benefits, particularly as the presumption in favour of sustainable development did not apply.
The less than substantial harm to the heritage asset and moderate harm to living conditions of future occupiers, together with the failure to secure mitigation for the SPA/SSSI, significantly and demonstrably outweighed the moderate benefits of nine additional housing units, building upgrading, economic benefits and brownfield reuse, resulting in dismissal.
