What decided it

The absence of a completed legal agreement securing the required contributions to the New Forest SPA Mitigation and Solent Recreation Mitigation Strategy, and nitrate credits to achieve nutrient neutrality, meant the Appropriate Assessment could not conclude beyond reasonable scientific doubt that the development would avoid an adverse effect on the integrity of the European Sites.

Although the proposal would contribute to housing land supply and provide social and economic benefits, the protection of European habitat sites under paragraph 11(d)(i) of the Framework provided a clear reason for refusing the development, and the presumption in favour of sustainable development was not engaged.
