Main issues, as the Inspector framed them

• whether the proposal would represent good design and its effects on the character and appearance of the area
• the effects on the living conditions of neighbouring occupiers at Nos 1, 3, 5, 7, 9 and 11 William Court, with particular regard to privacy and outlook
• whether the scheme would provide adequate open space for future occupiers
• whether the proposal would provide adequate parking for future occupiers

• the effects on the Thames Basin Heaths Special Protection Area (TBH SPA)

What decided it

The failure to secure the necessary mitigation measures to avoid adverse effects on the integrity of the Thames Basin Heaths Special Protection Area, combined with the identified harms to character, appearance, neighbouring living conditions and open space provision, meant the benefits of housing delivery and brownfield redevelopment did not outweigh the identified harms.

The benefits of three dwellings as a windfall brownfield redevelopment scheme in a sustainable location, together with economic benefits and the cessation of industrial use, were outweighed by the harms to character and appearance, neighbouring living conditions, open space and tree impacts, and the failure to mitigate effects on the TBH SPA, such that the proposal conflicted with the development plan as a whole.
