Main issues, as the Inspector framed them
- The main issue in all of the appeals is whether the planning obligations requested with respect to education and healthcare provision would meet the tests set out in Regulation 122(2) of the Community Infrastructure Levy Regulations 2010 (CIL Regs).
What decided it
The Inspector's finding that the four applications amounted to one comprehensive development exceeding the 100-dwelling contribution threshold, making the education contributions CIL-compliant, while the unsubstantiated healthcare contribution was not, within an otherwise agreed planning balance favouring the schemes.
The Council's overall planning balance in favour of the proposals (including housing benefits and comparison with extant permissions) was accepted by the Inspector as common ground, with the only live dispute being the education and healthcare contributions; resolving that dispute did not alter the conclusion that permission should be granted for all four appeals.
