The absence of secured mitigation for likely significant effects on the integrity of the Blackwater Estuary SPA and Ramsar site, combined with material harm to character and appearance, rendered the proposal contrary to the development plan and the Habitats Regulations.

Although the Council cannot demonstrate a five-year housing land supply, the protection of European designated sites under the Framework provides a clear reason for refusal, displacing the presumption in favour of sustainable development; the harm to character and appearance and the unmitigated effects on designated habitats sites outweighed the limited housing and economic benefits.
