What decided it

The absence of a legal mechanism to secure the required mitigation for likely significant effects on the integrity of the Dorset Heathlands SPA and New Forest SPA, combined with unresolved parking stress and failure to meet the mandatory biodiversity net gain requirement, provided strong reasons to refuse the development that material considerations could not outweigh.

Although the proposal would contribute to housing supply, make effective use of land and reuse brownfield land in a sustainable location with good access to services, these benefits were outweighed by the likely significant adverse effects on the integrity of European habitat sites without adequate mitigation, the unresolved parking stress on a constrained street, and the failure to meet the mandatory biodiversity net gain requirement; the presumption in favour of sustainable development did not apply due to paragraph 195 of the NPPF.
