Main issues, as the Inspector framed them

  • the effect of the proposed development on protected species
  • the living conditions of existing occupiers of the nearby dwellings and future occupiers of dwellings that might arise through the redevelopment of other parts of the wider site in the future
  • housing supply

What decided it

The absence of an appropriate ecological survey to establish the presence or otherwise of protected species and assess potential harm to biodiversity meant the proposal could not be shown to comply with Policy N2 of the NPPF and local policies protecting legally protected species, and the benefits were substantially outweighed by this adverse effect.

The economic benefits of commercial development and moderate positive weight given to improvements in character and appearance were substantially outweighed by the inability to assess and mitigate harm to protected species, a matter of primary importance.
