What decided it
The proposal would conflict with the Habitats Regulations and Policy CS33 because the unexecuted legal agreement could not guarantee mitigation of adverse effects on European Protected Sites, and the appellant failed to provide sufficient evidence of non-viability of the hotel use contrary to Policy CS28 and the Tourism SPD.
The modest housing contribution was outweighed by the failure to demonstrate loss of viable tourist accommodation and the unmitigated risk to European Protected Sites, such that the exception in NPPF paragraph 11(d) applied and the tilted balance was not engaged.
