• For Appeals A, B, K, L, M, P, Q, R and S: whether the proposals would preserve or enhance the character or appearance of the Conservation Area and nearby listed buildings, the effect of the proposals on the amenity of the area and public safety, and the effect of the proposals on crime and anti-social behaviour
• For Appeals C, D, E, F, G, H, I, and J: the effect of the proposals on the character and appearance of the area, the effect of the proposals on the amenity of the area and public safety, and the effect of the proposals on crime and anti-social behaviour
• For Appeals N and O: whether the proposals would preserve or enhance the character or appearance of the Conservation Area, the effect of the proposals on the amenity of the area and public safety, and the effect of the proposals on crime and anti-social behaviour

What decided it

In each appeal, the harm found to visual amenity and the character and appearance of the area (and, where relevant, to conservation areas and listed building settings) outweighed the absence of highway/public safety or crime harm and the moderate-weighted benefits, resulting in conflict with the development plan as a whole.

The lack of highway safety, public safety or crime and anti-social behaviour harm, together with moderate weight attributed to the public benefits of the Street Hub Units, did not outweigh the significant harm found to visual amenity, character and appearance and, in some appeals, to heritage assets, so the balance tipped against the proposals and each appeal was dismissed.
