Main issues, as the Inspector framed them

  • whether future occupiers of the proposed development would have satisfactory and safe living conditions

What decided it

The evidence did not establish that the appeal property was located in an area of unusually high crime or that the proposal would fail to provide a safe and secure environment for future occupants, particularly given the management regime and supporting documentation provided.

Framework Policy S4 requires that development proposals within settlements should be approved unless the benefits would be substantially outweighed by any adverse effects; the substantial weight given to meeting evidenced accommodation needs for children's homes and the provision of a safe and secure environment outweighed any concerns, and there were no material considerations that would lead to a decision other than in accordance with the development plan.
