Main issues, as the Inspector framed them
- The effect of the proposals on the visual amenity of the area (both appeals) having regard to the setting of the Scarborough Conservation Area, and the listed buildings known as The Grand Hotel and the St Thomas's Hospital
What decided it
The harm to the setting and significance of the listed buildings and conservation area, which would substantially outweigh the public benefits of the communications infrastructure, particularly given the lack of clear justification for the location and the failure to minimise visual impact as required by Policy CO1(1).
The benefits of the proposed development, including communications infrastructure and public safety benefits, would not be sufficient to outweigh the substantial weight given to the conservation of the designated heritage assets and the harm to their significance through effects on their setting; the adverse effects on visual amenity and heritage significance would substantially outweigh the stated benefits when assessed against the national decision-making policies of the Framework.
