Main issues, as the Inspector framed them

  • Whether the period specified in the enforcement notice for compliance falls short of what should reasonably be allowed under section 174(2)(g) of the Town and Country Planning Act 1990

What decided it

The previous Inspector's finding that the Council's gypsy and traveller pitch need had been met and exceeded, combined with the inevitability of the appellant's departure under ground (g), meant 6 months was a reasonable compliance period.

The balance between the appellant's Article 8 rights and the best interests of the children residing at the site against the public interest in remedying the breach promptly and protecting the character and appearance of the countryside and National Landscape tipped in favour of upholding the notice with the 6-month compliance period.
