Main issues, as the Inspector framed them
- the effect of the proposal on the character and appearance of the surrounding area
- the effect of the proposal on the living conditions of future occupants of Flat 1 regarding outlook and daylight, and Flats 1 and 2 regarding privacy, noise and the amount of private outdoor space
- the effect of the proposal on the living conditions of the occupants of Nos 239A and 241A regarding privacy and of No 239A regarding outlook
- whether the proposal would make adequate provision for cycle and waste storage
What decided it
The fundamental conflict with Framework Policy D3 relating to character and appearance, which stipulates permission should be refused in such circumstances, substantially outweighed the benefits of housing delivery and effective use of land.
Whilst the benefits of housing supply and effective use of land attracted substantial weight, the proposal would be in fundamental conflict with Framework Policy D3 on character and appearance, and applying Framework Policy S4, the benefits would be substantially outweighed by the adverse effects, so the proposal did not benefit from the presumption in favour of sustainable development.
