Main issues, as the Inspector framed them

  • The suitability of the site as a location for the proposed development, with particular reference to the requirements of the Development Plan
  • The effect of the proposed development on the living conditions of nearby occupants with regards to noise and disturbance, crime and anti-social behaviour

What decided it

The absence of any demonstrated need for a children's home within the Borough, combined with the loss of a family dwelling at a time of acute housing shortage, meant the benefits of the proposal were substantially outweighed by adverse effects under Policy S4 of the Framework.

Applying Policy S4, the limited benefits of providing specialist residential accommodation for two children (to which only limited weight was attached given the absence of demonstrated local need) were substantially outweighed by the significant harm of the loss of a family dwelling for which there is an evidenced need in the context of the Council's high Local Housing Need of 389 dwellings per year.
