Main issues, as the Inspector framed them

  • the effect of the development on the character and appearance of the host dwelling and the surrounding area
  • the effect of the development on the living conditions of the occupiers of neighbouring properties, with particular regard to overlooking

What decided it

The existence of a lawful development certificate for the majority of the works, to which significant weight was given, meant the further visual effect of the appeal scheme would be relatively limited and not harmful to character and appearance or living conditions when assessed against that fallback.

Policy S3(1)(c) of the Framework establishes a presumption in favour of sustainable development; the proposal accords with the development plan taken as a whole and is consistent with the relevant national decision-making policies, so there are no material considerations that indicate a decision should be taken other than in accordance with the development plan.
