Main issues, as the Inspector framed them

  • whether the proposed development would be in a suitable location, having regard to neighbourhood, local and national policy
  • whether the proposed development would satisfy the criteria of being a self-build dwelling
  • whether the proposed development would meet the requirements of the statutory framework for BNG

What decided it

The proposed dwelling would be disproportionately larger than the existing building it replaces and would therefore fail to meet the criteria in Policy S5(1)(c) of the Framework and Policy ST2 of the local plan that permit replacement dwellings in the countryside.

Applying Policy S5, the Inspector found that the proposal did not fall within a category of development that should be approved outside settlements, and the benefits of the proposal would not substantially outweigh the adverse effects on the open countryside, so the appeal should be dismissed in accordance with the development plan.
