Main issues, as the Inspector framed them
- whether the proposed development would result in an unacceptable loss of the public house
- the effect of the proposed development on the living conditions of nearby residents, with particular reference to noise, vibration and odour
What decided it
The public house was not a key community facility and did not hold heritage, cultural, economic or social value, so the protective policies requiring marketing evidence did not apply, and the mitigation measures in the Noise Impact Assessment and Odour Assessment were sufficient to protect living conditions.
The Inspector balanced the loss of a public house use against the absence of evidence that it held heritage, cultural, economic or social value and the acceptability of the proposed restaurant use subject to mitigation measures for noise, vibration and odour, allowing the appeal.
