Main issues, as the Inspector framed them
- The effect of the proposed development on the living conditions of the occupiers of the neighbouring properties at No. 23 Brookfield Lane and No. 27 Brookfield Lane, with regard to privacy
What decided it
The enclosed area created by the balustrade would result in harmful levels of overlooking towards the rear garden areas of neighbouring properties, resulting in an unacceptable loss of privacy for neighbouring occupiers, to the detriment of their living conditions, which substantially outweighs any identified benefits when assessed against Policy S4 of the Framework.
Applying Policy S4 of the Framework, the identified benefits of granting planning permission (fall prevention and climate change adaptation) were substantially outweighed by the adverse effects of harmful overlooking and unacceptable loss of privacy for neighbouring occupiers.
