The occupiers of Rooms 2 and 7 were substantially prejudiced by the failure to serve the enforcement notice on them individually, compounded by the Council's misleading information about the status of the ground (a) appeal, and this prejudice could not be disregarded under section 176(5) of the 1990 Act.
