The lack of any available alternative Gypsy and Traveller sites and the appellant's personal need for accommodation outweighed the identified harm sufficiently to justify a temporary, personal permission rather than a permanent one.
The significant harm to character and appearance and the very significant conflict with flood risk policy, together with the less sustainable location, were not outweighed by the benefits of meeting general and personal Gypsy and Traveller need for a permanent permission, but those benefits were sufficient to outweigh the harm for a temporary, personal permission of three years.
