What decided it
The roof terrace's configuration, with clear glass balustrades on all three sides and decking, facilitated more extensive and intrusive views of neighbouring properties and gardens than would occur from the existing patio doors, causing significant overlooking and unacceptable loss of privacy to neighbouring occupiers.
The Inspector balanced the appellant's safety concerns for young children and need for roof access against the significant harm to neighbouring privacy and living conditions, finding that alternative safety measures such as a Juliet-style balcony could provide periodic maintenance access without the extensive balustrading and decking that would encourage broader use of the roof terrace.
