The intervening material change of use to a garden centre and aggregates business during the 10-year period prior to the enforcement notice prevented the scrap metal use from acquiring lawfulness through the passage of time, and the harmful effects on character and appearance and highway safety were not outweighed by the limited benefits of the development.
