In light of the eventual extent of common ground between the Council and appellant, the main issue is whether there are any other considerations that might indicate that the appeal should be dismissed.

What decided it

The proposed crematorium would have significantly less impact on wider landscape views, including from the AONB, than the already-permitted fallback chapel scheme.

In the absence of any harm identified in any respect, and with the scheme causing less harm to the character and appearance of the countryside than the fallback position, the balance favoured allowing the appeal.
