Main issues, as the Inspector framed them
- Whether the variation of Conditions 8 and 9 would be acceptable having regard to the effect of the proposal on the living conditions of the occupiers of neighbouring properties in respect of noise
What decided it
The proposed variation of Conditions 8 and 9 would intensify use of the kart track and reduce respite for neighbouring occupiers, causing harm to living conditions through noise that exceeds the Lowest Observed Adverse Effect Level, contrary to the development plan and NPPF.
The benefits of supporting an established rural business and enabling increased use of a popular recreation facility were outweighed by the harm to the living conditions of neighbouring occupiers through increased and extended noise exposure.
