Main issues, as the Inspector framed them

  • the effect of the development on the living conditions of neighbouring occupiers at 2 Linford Lane and 42 Portland Drive with regard to outlook and privacy
  • the character and appearance of the area

What decided it

The unacceptable overbearing effect on the outlook of neighbouring occupiers at 2 Linford Lane and 42 Portland Drive caused by the long, unbroken west wing extension along the shared boundary, which would greatly enclose their rear gardens despite the acceptable character and appearance of the development.

The benefits of providing additional and more flexible living space for the appellant's elderly relatives did not outweigh the harm caused to neighbouring living conditions in terms of outlook.
