Main issues, as the Inspector framed them
- whether the appeal site is a suitable location for a house in multiple occupation (HMO)
- the effect of the proposed development on highway safety with regard to parking provision
What decided it
The proposal's failure to comply with the HMO concentration threshold and the unacceptable harm to highway safety arising from inadequate parking provision meant that Policy S4(2)(c) of the Framework prevented the presumption in favour of sustainable development from applying.
Policy S4 of the Framework would normally require approval unless benefits were substantially outweighed by adverse effects, but the proposal's breach of national decision-making policies L3 and TR6 meant the presumption did not apply and the proposal should be refused in accordance with the development plan.
