The absence of any evidence of actual harm from the use operating since 2016, combined with demonstrated economic benefits and the lack of sequentially preferable alternative sites, outweighed the technical non-compliance with employment land policy.

The economic benefits of the leisure use and the absence of demonstrated harm to parking, highway safety or neighbouring uses outweighed the loss of employment land, particularly given the adequate supply of alternative employment sites in the area and the lack of sequentially preferable locations for the nightclub use
