Main issues, as the Inspector framed them

  • Whether the disputed condition is necessary to protect the living conditions of the occupiers of Fairview and Little Ridge, with particular regard to outlook and noise; the effect on the character and appearance of the area; and the effect on biodiversity

What decided it

The reduced width of landscaping now proposed would be insufficient to adequately safeguard the outlook of neighbouring residents and allow those properties to feel separate from the industrial site, particularly during winter months when leaf cover is limited.

The necessity to protect the living conditions and outlook of neighbouring residential properties outweighed the appellant's desire to vary the landscaping condition to a less extensive scheme.
