What decided it
The total amenity space available at No 90 (approximately 107sqm) exceeds the SPD's minimum requirements for a four-bedroom dwelling, whereas at No 88 it falls significantly short, justifying differential treatment of the two properties.
The restriction on permitted development rights under Classes B and C was justified at No 88 to protect adequate private amenity space in the interests of living conditions, but was unreasonable and unnecessary at No 90 where sufficient amenity space would be maintained.
