Main issues, as the Inspector framed them

  • The effects of the development on the Wye Valley and Forest of Dean Bat Sites Special Area of Conservation (SAC)

What decided it

The acceptance of a genuine fallback position secured by Unilateral Undertaking, which ensured no net increase in poultry numbers and therefore no additional traffic movements over the SAC's cave system, eliminated the adverse effects on the protected site that had led to dismissal of the previous appeal.

The development, when considered with the fallback position and the Unilateral Undertaking limiting poultry numbers to 16,162 birds, would have a neutral effect on the SAC and would comply with development plan policies protecting conservation sites, outweighing the previous concerns about adverse effects on the Favourable Conservation Status of bat species.
