Main issues, as the Inspector framed them
- Whether it is necessary and reasonable to restrict the occupation of the dwelling to persons with a local connection who would use it as their only or principal home to meet an identified local need
What decided it
The appeal property provides satisfactory living conditions for permanent residential occupancy and the appellant has not clearly demonstrated that there is no interest in it as permanent residential accommodation, therefore the local occupancy restriction is necessary and reasonable to meet identified local housing need.
The benefits of retaining the local occupancy restriction to support a vibrant and resilient community and balanced housing market outweighed the appellant's desire to use the property for holiday letting, notwithstanding the heritage considerations of sustaining the listed building in a viable use.
