What decided it

The Council's failure to determine the application within the statutory period combined with its inability to provide clear communication about timescale and outcome, followed by approval of an identical application, constituted unreasonable behaviour causing unnecessary expense, but a partial award was appropriate because mitigation was not secured under the appeal proposal and post-approval costs were not necessary.
