Main issues, as the Inspector framed them
- The effect of the proposed variation to the disputed condition on the living conditions of neighbouring residents, with particular regard to noise, disturbance and light pollution
What decided it
In Appeal A, the material harm to neighbouring residents from the intensity and frequency of use throughout the day and at times when residents are at home outweighed the benefits of providing a community facility for religious worship. In Appeal B, the restricted hours proposed would avoid the most sensitive times for residential amenity and therefore would not result in material harm.
