The fallback position of the already-permitted scheme, which would have a substantially similar impact, combined with the mitigation of the overbearing effect through the extension's location and the limited use of the affected garden area as an amenity space, led the Inspector to conclude the proposal would not unduly harm living conditions at the neighbouring property.
