What decided it
The absence of sufficient evidence to demonstrate that the proposed development would not lead to adverse effects on the integrity of the Chilterns Beechwoods SAC, which under the Habitats Regulations provides a clear reason for refusing the development.
Although the proposal would accord with Green Belt and AONB policies and would benefit from the Council's inability to demonstrate a five-year housing land supply, the requirement under the Habitats Regulations to avoid adverse effects on the integrity of the SAC, an area of particular importance, outweighed these considerations and prevented the presumption in favour of sustainable development from applying.
