The proposal would be likely to have a significant effect on the integrity of the Chichester and Langstone Harbours Special Protection Area and the mitigation measures could not be properly secured, resulting in conflict with the Habitats Regulations and Policy DM24.
Although the proposal would not harm character and appearance and would provide sufficient outdoor amenity space, these benefits could not outweigh the conflict with the Habitats Regulations and the development plan; the tilted balance was not engaged due to the protection of habitats sites as assets of particular importance.
