What decided it
The great weight required to be given to the conservation of the designated heritage asset under paragraph 199 of the NPPF, combined with the finding that the limited public benefits of two dwellings would not outweigh the less than substantial harm to Church Brook Conservation Area under paragraph 202, provided a clear reason for refusal that displaced the tilted balance.
The less than substantial harm to Church Brook Conservation Area and very significant harm to biodiversity were weighed against the limited public benefits of delivering two market dwellings and associated socio-economic activity; the heritage harm and biodiversity loss outweighed the housing benefits, and the conservation area protection policies provided a clear reason for refusal under paragraph 11(d)(i) of the NPPF.
