Main issues, as the Inspector framed them

  • The effect of the access on highway safety

What decided it

The access arrangements do not demonstrate that vehicles can consistently access and egress the site in forward gear with satisfactory visibility splays, contrary to policies CN9, EM10 and the development plan as a whole.

The development conflicts with the development plan and material considerations including the NPPF do not indicate that the appeal should be decided other than in accordance with the development plan; Policy S5 of the NPPF does not point to permission being granted as the access does not fall within stated categories of development or exceptional circumstances, and therefore the development does not benefit from the presumption in favour of sustainable development.
