Main issues, as the Inspector framed them

  • The effect of the proposed development on the supply of family housing in the area
  • Living conditions for occupiers of the adjoining dwelling at No 215 Elm Park Avenue, with particular regard to outlook and whether it would be overbearing
  • Car parking stress in the area

What decided it

The presumption in favour of sustainable development under NPPF paragraph 11d), triggered by the Council's inability to demonstrate a five-year housing land supply, outweighed the conflict with Policy 9 on family housing supply, particularly given the moderate weight afforded to the fallback position and improved quality of the proposed development.

The conflict with the development plan on family housing supply was outweighed by the presumption in favour of sustainable development under NPPF paragraph 11d), the moderate weight of the fallback position providing better living conditions than the existing extension, and the absence of significant harm to neighbouring amenity or parking, resulting in permission being granted.
