The absence of a legal mechanism to prevent implementation of the extant planning permission meant the proposal could result in an additional dwelling in a countryside location contrary to the spatial strategy, and even if resolved, the proposed dwelling would fail to meet Policy HS10 requirements for replacement dwellings due to its harmful impact on character and appearance.
