The noise assessment evidence demonstrating that predicted noise levels would be below British Standard thresholds and not distinguishable against background night-time noise, combined with the absence of evidence of anti-social behaviour from existing 24-hour gaming premises in the town centre, established that Condition 3 was not necessary to protect neighbouring residents.
The benefits of promoting the night-time economy and supporting leisure uses in the town centre, as required by Policies TC2 and HC6, outweighed the Council's concerns about noise and public safety, which were not substantiated by evidence
