The absence of a secured planning obligation to provide Strategic Access Management and Monitoring contributions to mitigate significant effects on Protected Sites meant the proposal could not be granted permission under the Habitats Regulations.
The modest benefits of housing supply and economic advantages were outweighed by the inability to mitigate significant effects on Protected Sites through the Habitats Regulations, which provided a clear reason for refusal under paragraph 11(d) of the Framework.
