The failure to demonstrate that the development would not adversely affect the integrity of the Arun Valley Sites through water abstraction, which under Regulation 63 of the Habitats Regulations prevented the Inspector from granting permission.

The substantial benefits of housing delivery and efficient use of previously developed land were outweighed by very great weight attached to the harms to protected habitats and the conflict with spatial strategy, with the presumption in favour of development displaced by the protected habitat impacts.
