Main issues, as the Inspector framed them
- The effects of the proposals on the character and appearance of this part of Lime Grove
- The living conditions of future occupiers of the development, in terms of outdoor garden/amenity space
- The living conditions of occupiers of the nearby flats at Kavanaugh Court and of the development itself, with particular regard to privacy
- The safety of highway users
- The safety from fire of future occupiers of the development (Appeal A only)
What decided it
The proposals would not provide conveniently accessible outdoor garden/amenity space for future occupiers, particularly the upper floor flats, which would fail to meet the requirements of the development plan and the National Planning Policy Framework's emphasis on good design and healthy living conditions.
The significant benefits of delivering 6-7 new dwellings in a sustainably located site were outweighed by the adverse impacts of inadequate and inconveniently accessible outdoor amenity space for future occupiers.
