Main issues, as the Inspector framed them

  • the effect of the proposed development on the character and appearance of the area, with particular regard to the Surrey Hills National Landscape and an Area of Great Landscape Value
  • whether the future occupiers of the proposed development would be likely to experience adequate living conditions, with specific reference to privacy and daylight
  • the effect of the proposed development on the living conditions of existing occupiers of Far Ben, with specific reference to external amenity space
  • whether the location of the appeal site would be suitable for the proposed dwelling, having regard to the Framework

What decided it

The proposed development would cause harm to the character and appearance of the Surrey Hills National Landscape and Area of Great Landscape Value by introducing a cramped dwelling in a stepped arrangement that disrupts the prevailing pattern of development, which is a clear reason for refusal that engages the Framework's protection of such areas.

The neutral factors regarding the location and existing occupiers' amenity space did not outweigh the harm to the character and appearance of the national landscape and the inadequate privacy for future occupiers.
